Donated Equipment. I am donating these item(s) to The Shore Foundation (the “Donated Equipment”) Condition “As Is”. The Donor is not making any representations, warranties, or guarantees about the Donated Equipment, including any implied warranties of merchantability and/or fitness for any purpose. I am releasing the Donated Equipment “as is.” Waiver and Release. I waive and release any and all claims against The Shore Foundation, its officers, agents and employees (collectively, “SF Parties”) with respect to any and all injury, disability, death, loss or damage to property resulting from possession, use or misuse of the Donated Equipment, regardless of the cause and even if caused by negligence, whether passive or active, including those claims not known to me at the time I signed this document. I agree not to sue any of the SF Parties on the basis of these waived and released claims. Indemnity. I will defend, indemnify and hold the SF Parties harmless from and against any and all liability, loss, damages, claims and attorney’s fees that may be suffered by any SF Party resulting directly or indirectly from the possession, use or misuse of the Donated Equipment, except and only to the extent the liability is caused by the gross negligence or willful misconduct of an SF Party. Technology. I understand that the computer/technology I am donating may have existing faults and software or hardware limitations. I understand that The Shore Foundation is not responsible for providing computer support or additional equipment once I have donated the computer to The Shore Foundation. I will not hold The Shore Foundation responsible for any consequences of software or hardware malfunctions, viruses, or equipment failure. The Shore Foundation will evaluate the donated technology/items for quality, ability to be refurbished, processor speed (if applicable) and if it meets the needs of the program. It is at the discretion of The Shore Foundation to determine the most impact the donation would have to the organization whether that is through program distribution, ewaste scrap, sale or internal use. I have read and understand the terms of this agreement. I understand that this agreement covers each and every item of Donated Equipment which I am donating. I sign it freely and voluntarily.
